Ness Energy Wins Lawsuit Eliminating Litigation Burden and
Risk
WILLOW PARK, TEXAS, U.S.A./ NETANYA, ISRAEL: October 15,
2003/PRNewswire-FirstCall/ -- Ness Energy International, Inc. (OTC
Bulletin Board: NESS) announced it has successfully won the only
pending litigation involving the Company. A lawsuit had been
pending for some time now in Ector County, Texas. Ness indicated
last week it felt it would be able to confirm a successful result,
and now is able to do so, after review of the court directed
order.
Background
In July 2000, a complaint was filed by Chow-Taw, Inc., et al
vs. Ness Energy International, Inc., et al with the District Court
in Ector County, Texas, the heart of the Permian Basin, demanding
payment of a $325,000 commission for the purchase of an Ideco
H-3000 drilling rig. Ness and it's counsel emphatically denied all
liability whatsoever to plaintiff. This denial was based upon the
fact that Ness never had a contract with the plaintif. Ness
mounted a vigourous defense in this matter before a binding court
ordered arbitration. "As in most court cases where you have a
judge or jury, you never know how they will decide, so there was
some uncertainty as to what the ruling would be. We knew we
were in the right, we were certain of that, our concern was
regarding fairness and proper interpretation of facts by the
arbitrator." commented Ness President Sha Stephens.
Ness Wins
Ness Energy International, Inc. and related parties were
exonerated of all complaints that were brought, which were based
on breach of contract and quantum meruit.
Sha Stephens, President of Ness, recently took charge of
dealing with Ness counsel to finalize the defense of the suit,
including attending a lengthy preparation, and the proceeding,
involving court ordered arbitration.
According to President Stephens, "We were subjected to a suit
we thought to be unfounded and unfair. We had not done
anything to create the suit, therefore we felt we had no
liability. Many companies and professionals are attacked by these
type of lawsuits, we had to muster our resources and defend. The
arbitrator conclusion was based on good, solid truth brought forth
by our excellent counsel. All claims for awards sought by the
plaintiff were Denied." Not only did the plaintiff lose the
claims, they also failed on a demand of attorney fees against
Ness.
The company filings, which have carried disclosure of the suit,
somewhat of a negative point to potential investors, will be
properly amended or updated to reflect the ruling, and therefore
remove the concern of any pending legal action against Ness Energy
Internatonal, Inc.
President Stephens also stated, "Recently Ness Energy, by
determination of the accountants, was able to remove the financial
'going concern' risk in its financial statements. Now we are again
able to report another positive event for our Company which will
result in the removal of all 'pending litigation concern' from our
SEC filings. We feel, beyond doubt, that these events will benefit
us in our business dealings."
Other News
Ness continues with acquisition plans, and also, in addition,
schedules meetings in Wall Street for the coming week,
aniticipating additional news both this week and next on these
matters of importance.
